Festival Beach Community Garden Contract, Jan-Dec 2012
I, ___________________________ agree to follow the guidelines listed below, and I accept the following responsibilities. I understand that this is required in order for me to be a participating gardener at Festival Beach Community Garden.
I accept full responsibility for the maintenance of my individual garden plot, and I accept shared responsibility for maintenance of the common areas, furnishings, and equipment, including fencing, trees, trash receptacles, compost bins, and tool sheds.
I will contribute two hours of labor per month for the maintenance of common areas. As an alternative, I agree to pay $10 per month in lieu of labor. I will document my work hours each month in the Work Hours Notebook (located in the green tool shed).
In addition to my two hours of labor per month, I agree to participate in one of the Community Garden’s committees or stewardship teams or hold a leadership position.
I will submit a rental payment of $35.00 for the 2012 calendar year, and to pay annual rental payments in the amount set by the Steering Council in January of each year as long as I remain a gardener. I understand that this payment is not refundable if I leave before the end of the year. (Scholarships are available by application in cases of financial hardship).
I will notify the garden leadership at info@festivalbeachgarden.org or (512) 508-8320 if I cannot care for my plot. During periods of absence from my garden, I will make arrangements to have my plot watered and maintained. I understand that I will be notified if my plot appears neglected or abandoned, and if the situation is not corrected, my plot may be forfeited.
I will remain on the premises while my garden is being watered.
I will not use chemical herbicides, pesticides, fungicides, or synthetic fertilizers on my garden or anywhere on the site. Violation of this rule is grounds for immediate plot forfeiture.
I will notify the Garden Coordinator upon voluntary termination of my contract and clear my plot of all dead plants, weeds, trash, tools, sticks, and/or cages.
I agree to follow the By-laws of the Festival Beach Community Garden and the Rules for Garden Maintenance. Both documents are attached to this contract.
WAIVER AND RELEASE
The joint membership of Festival Beach Community Garden, Sustainable Food Center and the City of Austin Parks and Recreation Department are not responsible for personal injury or property damage incurred by any plot renter, or for theft, loss or destruction of any property owned by any plot renter.
By signing this contract, I assume full responsibility for conducting myself in a civil manner and agree to not engage in unacceptable conduct, including but not limited to vandalism, consumption of alcoholic beverages, possession and/or use of illegal drugs, verbal and/or physical harassment and/or abuse, defamation, and littering while on site.
I understand and agree that the joint membership of Festival Beach Community Garden and persons and organizations involved with Festival Beach Community Garden shall not discriminate on the basis of race, creed, color, national or ethnic origin, religion, marital status, age, sex, sexual orientation, or disability, in the administration of its programs.
In the event that a dispute arises between gardeners, or between a gardener(s) and the designated garden leadership, and a resolution of the dispute cannot be reached by these parties, I agree to have the Steering Council of Festival Beach Community Garden act as the arbiter of the dispute, and I further agree to adhere to the decision of the Steering Council of Festival Beach Community Garden as final.
I have read the foregoing contract and waiver and release of liability and voluntarily executed this with full knowledge of its content and intending to be legally bound.
